Welcome to kategos. Please read these Terms of Service (“Terms”) carefully before using our website, services, and AI-powered chat assistant (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you are not authorised to use our Services.

1. Acceptance and Eligibility

By using the Services, you represent and warrant that:

• You are at least 18 years of age (or the age of majority in your jurisdiction).
• You have the legal authority to enter into a binding agreement.
• Your use of the Services does not violate any applicable law or regulation.

2. Changes to the Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice via a notice on the website. Your continued use of the Services after the effective date constitutes acceptance of the new Terms.

3. Account Registration and Security

The public site does not require an account to browse content, ask kategos Intelligence questions, or request white papers. Internal CMS access at /admin is reserved for the kategos team; account holders are responsible for safeguarding their credentials and must notify us immediately at legal@kategos.ai of any suspected breach.

4. Use of the AI Assistant

kategos provides an automated, AI-powered chat assistant (“kategos Intelligence”) to help visitors find information from our published material.

• No professional advice. Replies are for informational purposes only. They do not constitute professional, legal, financial, or technical advice. Decisions about your business should be confirmed with the kategos team or qualified advisors.
• Accuracy disclaimers. The assistant uses third-party generative AI services (Voyage AI for embeddings, OpenAI for response generation). Replies may contain errors, omissions, or hallucinated facts. We do not guarantee accuracy, completeness, or reliability. Verify critical information before relying on it.
• Source restriction.The assistant is instructed to answer only from kategos' own published content. If a question is outside that scope, the assistant will say so and invite you to contact the team.

5. User Content and How We Handle It

You retain all ownership rights to the prompts, text, and data you submit to the Services (“User Content”).

We do not train any AI models on your User Content. Your chat inputs are sent to Voyage AI and OpenAI for one-time processing to generate a single reply. Under both vendors' default API terms, those inputs are not used to train their models either. We retain your chat question in our database only if you choose to submit the inline contact form inside the assistant.

Sensitive data. Do not input highly sensitive personal information, proprietary code, trade secrets, confidential documents, or regulated financial or health data into the assistant. kategos is not responsible for any liability arising from your submission of confidential or sensitive information.

6. Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose or to promote illegal activity.
• Submit material that is defamatory, obscene, abusive, threatening, harassing, or discriminatory.
• Attempt to reverse-engineer, decompile, “jailbreak,” or bypass the safety filters or operational constraints of the chat assistant.
• Deploy scrapers, bots, spiders, or other automated systems to extract data from the site without our prior written consent.
• Submit copyrighted material or intellectual property that you do not own or have a licence to use.

7. Privacy, Analytics, and Cookies

Our handling of your data is governed by the Privacy Policy. The site does not currently deploy third-party analytics or advertising trackers; only essential first-party storage is used.

8. Intellectual Property

Excluding your User Content, all content on the Services — including text, software, graphics, photos, videos, the kategos brand mark, and the proprietary configurations behind our AI integrations — is owned by or licensed to kategos. All rights reserved.

9. Third-Party Dependencies

The Services run on third-party infrastructure including Supabase (database and storage), Vercel (hosting), Voyage AI (embeddings), OpenAI (chat generation), and Resend (transactional email). kategos has no control over and assumes no responsibility for the content, policies, or practices of these providers. Outbound links to other websites are likewise outside our control.

10. Termination

We may terminate or suspend access to the Services immediately, without prior notice or liability, for any reason — including breach of these Terms. On termination, your right to use the Services ceases.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. KATEGOS DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KATEGOS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR SUPPLIERS (INCLUDING SUPABASE, VERCEL, VOYAGE AI, OPENAI, AND RESEND) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of, or inability to use, the Services;
• Any reasoning, output, or content obtained from or generated by the AI assistant;
• Any conduct or content of any third party on the Services;
• Unauthorised access, use, or alteration of your transmissions or content.

13. Indemnification

You agree to defend, indemnify, and hold harmless kategos and its licensees, licensors, employees, contractors, agents, officers, and directors from any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney fees) arising from: (a) your use of the Services; (b) breach of these Terms; or (c) User Content you submit that infringes third-party intellectual property or privacy rights.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-law provisions. Any legal action arising under these Terms will be brought exclusively in the courts located in Nevada, USA.
